“There are different types of conservatorships,” he continues. “For instance, a conservatorship of the person focuses on personal care decisions like housing and medical treatment, while a conservatorship of the estate handles finances.

Ted smiles knowingly, “This process is designed to be thorough and protect the rights of everyone involved. It all starts with filing a petition in court, outlining why a conservatorship is necessary.” He pauses for emphasis.

  • “Notice must be given to the individual who may need the conservatorship (the proposed conservatee) and their family members.”
  • “A court investigator or social worker then conducts an independent assessment of the situation.
  • “Importantly, a medical or psychological evaluation is required to determine the conservatee’s capacity to make decisions.

“Finally, a judge reviews all the evidence and decides whether to grant the conservatorship.”
