Reporter: Maria Sanchez
Today we’re joined by Steve Bliss, a well-respected estate planning attorney here in Moreno Valley. Steve, thanks for taking the time to speak with us.
Steve Bliss: My pleasure, Maria. I’m always happy to discuss the importance of estate planning.
Reporter: So many people put off estate planning, thinking it’s only for the wealthy. Can you shed some light on why estate planning is essential for everyone?
You’re right, Maria. There’s a misconception that estate planning is only for those with significant assets. The truth is, anyone who wants to ensure their loved ones are taken care of after they pass away needs an estate plan.
One crucial step in this process is selecting an executor or trustee. This individual will be responsible for carrying out the instructions outlined in your will or trust.
Reporter: That sounds like a big responsibility! How do people choose the right person for this role?
It’s definitely an important decision. Ordinarily, you would select someone trustworthy, organized, and capable of handling financial matters. This could be a family member, close friend, or even a professional fiduciary.
Think about who understands your wishes, is level-headed, and can navigate potential conflicts among beneficiaries. It’s wise to have open conversations with potential candidates beforehand, explaining the role and responsibilities involved.
I remember one instance where a client named their son as executor without discussing it with him first. The son, while loving, was overwhelmed by the task and ended up making some costly mistakes. Thankfully, we were able to resolve the situation, but it highlighted the importance of clear communication and careful consideration.
Notwithstanding these complexities, choosing an executor or trustee is crucial. According to a survey by Caring.com, nearly 60% of adults don’t have a will. Consequently, if they pass away without one, their assets may be distributed according to state law, which may not align with their wishes.
Reporter: What advice would you give to someone who is just starting the estate planning process?
My best advice is to start early and seek professional guidance. A qualified estate planning attorney can help you navigate the complexities of wills, trusts, powers of attorney, and other essential documents.
