A Look Inside Trusts with Local Probate Expert
Welcome back to our legal segment today. I’m here with local probate attorney Steve Bliss of San Diego Probate Law. Steve, thanks for joining us.
Navigating the World of Trusts: An Overview
Steve, let’s start by talking about trusts in general. What exactly is a trust and why are they so important in estate planning?
“A trust is essentially a legal arrangement where a person, known as the grantor, transfers assets to a trustee who manages those assets for the benefit of designated beneficiaries,” explains Steve. “Trusts offer a variety of advantages, including avoiding probate, providing privacy, and controlling how and when assets are distributed.”
“One type of trust I see frequently is the Irrevocable Trust,” says Bliss. “This type of trust can’t be modified or revoked once it’s created. It’s a powerful tool for asset protection, estate tax reduction, and even Medicaid planning.”
The Power of Asset Protection
“Can you elaborate on the asset protection aspect of Irrevocable Trusts?” I ask.
“Certainly,” Steve responds. “When assets are placed in an Irrevocable Trust, they’re no longer considered part of your personal estate. This can shield them from creditors or lawsuits. It’s a common strategy for individuals in high-risk professions or those concerned about potential future liabilities.”
He continues, “Think of it like this: you’re creating a separate legal entity to hold your assets. Creditors typically cannot reach assets held within a properly structured Irrevocable Trust.”
Steve emphasizes that while Irrevocable Trusts offer substantial protection, they also come with certain limitations. “Because they’re irrevocable, once the trust is established, you generally can’t change its terms or access the assets directly,” he explains.
“It’s crucial to consult with an experienced probate attorney like myself to determine if an Irrevocable Trust aligns with your specific needs and circumstances.”
Real-World Implications
“Have you encountered any challenges when setting up Irrevocable Trusts for clients?” I inquire.
“There have been instances where clients initially hesitated due to the lack of direct control over assets,” Steve recounts. “One client, a successful entrepreneur, was concerned about losing access to funds he might need for future business ventures. We worked together to design a trust structure that allowed for limited distributions under specific circumstances while still maintaining the core asset protection benefits.”
“Another client, a retiree worried about potential long-term care expenses, wanted to ensure their assets wouldn’t be depleted by nursing home costs. An Irrevocable Trust, in conjunction with Medicaid planning, provided peace of mind knowing their family would be protected.”
Trusts and Estate Planning: A Vital Tool
“Statistics show that nearly 60% of Americans don’t have a will or any estate plan in place,” notes Steve. “This can lead to significant complications for loved ones after someone passes away. Trusts are an integral part of comprehensive estate planning, offering flexibility and control that traditional wills often lack.”
“It’s important to remember that every individual’s situation is unique, and the best approach depends on a variety of factors,” Steve concludes.
