Good evening Moreno Valley, and welcome back to our legal segment. I’m your host, Samantha Jones, and tonight we’re joined by Steve Bliss of Moreno Valley Probate Law. Mr. Bliss, thanks for joining us.
Trusts: A Cornerstone of Estate Planning
Steve, for those unfamiliar with the term, can you explain what a trust is in simple terms?
A trust is essentially a legal arrangement where a person (called the grantor) transfers assets to a trustee who manages those assets for the benefit of designated beneficiaries. It’s like creating a safe haven for your belongings, ensuring they are distributed according to your wishes even after you’re gone.
The Power of Irrevocable Trusts
We often hear about different types of trusts, but which ones do you find most beneficial for clients?
While there are many types of trusts, I find irrevocable trusts particularly powerful. Consequently, they offer significant benefits in terms of asset protection and estate tax planning. Once established, an irrevocable trust cannot be easily altered or revoked, providing a strong shield against creditors and potential lawsuits. Moreover, assets held within an irrevocable trust are typically removed from the grantor’s taxable estate, potentially reducing estate taxes for heirs.
Now, it’s crucial to remember that setting up an irrevocable trust is a serious decision. It involves relinquishing control over the assets placed within the trust. This means careful consideration and planning are essential before proceeding.
Navigating Complexity
I imagine you’ve encountered some unique situations with clients using irrevocable trusts. Can you share any insights?
Certainly. I recall working with a family who owned a successful business. They were concerned about potential liability and wanted to ensure the business assets remained protected for future generations. We established an irrevocable trust to hold the business shares, shielding them from personal creditors and lawsuits. The peace of mind it brought them was truly remarkable.
Conversely, I’ve also seen situations where individuals set up irrevocable trusts without fully understanding the implications. Notwithstanding its benefits, an irrevocable trust can be complex. It’s imperative to consult with an experienced estate planning attorney who can guide you through the process and ensure it aligns with your specific needs and goals.
Studies show that over 60% of Americans lack a basic estate plan. (“Estate Planning Statistics,” American Bar Association)
